Construction Workers Eligible for an NZ Border Exception

Navigating a move interstate is a challenge in these difficult times, let alone relocating to New Zealand. As a result of Covid-19, you must receive an NZ border exception to be accepted into the country.

There are mostly two options for construction workers based overseas to be eligible for an NZ border exception:

1. Be employed to work on an ‘Approved major infrastructure project’
2. Have Unique experience or skills not readily obtainable in NZ

Be employed to work on an ‘Approved major infrastructure project’

The employee must be undertaking a time-critical role for the delivery of an approved major infrastructure project. ‘Time critical’ includes if the person does not come to New Zealand, the project will be severely compromised, or significant costs will be incurred.

The New Zealand Infrastructure Commission, Te Waihanga maintains a list of projects considered ‘Approved major infrastructure project’. These are all projects in the Search Pipeline below worth NZ$100M+

Have Unique experience or skills not readily obtainable in NZ

The factors that an immigration officer may take into consideration when assessing “unique experience and technical or specialist skills” include whether these skills or experience:

• have been gained in a specialist training institution or by working in a highly-specialist firm
• can be demonstrated through global experience

“not readily obtainable” include, but are not limited to, whether:

• there are no workers in the country who could perform the role, or
• there is a very limited pool of available workers who could perform the role and they are not available to the employer.

An example of workers meeting this standard may include vendor-appointed engineers required to install major equipment.
